Scope

The General Terms and Conditions (hereinafter referred to as “GTC”) apply to all orders placed in person via the online store of Wüthrich Weinhandel und Keramik, contracts concluded as well as for booked ceramics courses and open studio.

Wüthrich Weinhandel und Keramik reserves the right to change the GTC. The version of the GTC valid at the time of the order shall apply in each case, which cannot be changed unilaterally for this order.

The offer is addressed to natural clientele resp. legal clientele domiciled in Switzerland or Liechtenstein. Deliveries are therefore only made to addresses in Switzerland or Liechtenstein. The offer is valid while it is visible in the online store and/or while stocks last. Price and assortment changes are possible at any time. The images shown in advertisements, brochures, in the online store, etc., as well as all information about the products (Food & Beverage Facts, etc.) are for illustrative purposes and are not binding. The specific information on the product packaging is decisive.

Rebooking and cancellation courses and events

Cancellation costs for courses up to:
28 days before the course: 25%
21 days before the course: 50%
7 days before the course: 100%
If we find a replacement participant, your course fee will be refunded, minus a processing fee of CHF 30.

Cancellation costs for events:
Up to 8 days before the event: free rebooking. Cancellation: CHF 100 processing fee.
From 7 days before the event: costs incurred (aperitif order, other expenses) will be charged.

Sale of alcohol to minors

According to legislation, the sale of alcohol to young people is subject to various restrictions. Wüthrich Weinhandel und Keramik generally does not sell alcohol to young people under the age of 18. By indicating the date of birth, the customer bindingly indicates his age, so that this regulation and the legal requirements can be complied with.

Price

The prices are in Swiss francs, incl. prepaid recycling fee (wine).The price in the online store at the time of the order is decisive. Ordered additional services that are subject to a charge, such as delivery, packaging, gift wrapping, etc., are listed separately on the invoice.

Order

The presentation of the products in the online store is not a legally binding application, but a non-binding online catalog or a non-binding invitation to the clientele to order the product in the online store. Wüthrich Weinhandel und Keramik reserves the right to limit the delivery quantities for certain products or not to execute the delivery if the order is exceptionally heavy or voluminous.

An order is considered an offer to Wüthrich Weinhandel und Keramik to conclude a contract.

After transmitting the order, the customer receives a confirmation of receipt, which documents that the order has been received by Wüthrich Weinhandel und Keramik.

Delivery

The customer’s delivery address must be in Switzerland or the Principality of Liechtenstein. While stocks last, products can be shipped by mail or picked up in person within a few days. It is not possible to specify an exact delivery time within the delivery period, and any claims for damages and other claims of the clientele in this regard are excluded.

No deliveries are made on Sundays and official national or cantonal holidays.

If the clientele is not on site at the time of delivery and has not left special delivery instructions “at the post office”, the delivery man will leave a collection invitation in the mailbox. The customer must then collect the delivery from the relevant post office.

The customer assumes responsibility for the products delivered, even if they have not been received directly by him.the customer must be able to show identification upon request. Orders containing alcohol can only be picked up by persons over the age of 18.

Delivery costs depend on the weight of the ordered products. The delivery costs are listed as an additional item on the invoice.

Delivery and packing

In addition to the final price, percentage costs for shipping and packaging are charged per order.

Warranty for wine

For quality and shelf life of the products Wüthrich wine trade and ceramics guarantees under the following conditions:

– Horizontal storage, cool temperatures, sufficiently high humidity, little light, stability and no foreign odors (for example, fuel oil).

Provided that compliance with these storage conditions is proven by the customer, Wüthrich Weinhandel und Keramik guarantees that the products ordered are free of defects in accordance with the statutory regulation of 2 years from delivery.

Wüthrich Weinhandel und Keramik may provide warranty either by partial or complete replacement with an equivalent product, credit up to a maximum of the sales price at the time of the order, or reduction.

There is no general right to return defect-free and correctly delivered products. The warranty is explicitly excluded for products whose intrinsic quality (e.g. taste quality) does not meet the requirements of the customer, goods that are spoiled due to improper handling by the customer and products ordered by mistake.

Notice of defects

If products are delivered with obvious damage to the packaging or contents, the customer must immediately complain to the delivery carrier and refuse acceptance, without prejudice to his rights in respect of defects. The customer is obligated to obtain a damage confirmation message from the delivery carrier. All transport damage must also be reported immediately to Wüthrich Weinhandel und Keramik.

Furthermore, it is the customer’s responsibility to check the ordered products immediately upon receipt and to store them correctly. For any defects or deviations from the order, Wüthrich Weinhandel und Keramik must be notified on the day of delivery either by telephone or by e-mail. After that, only hidden defects can be claimed. The amount paid by the clientele for the defective goods will be credited to the customer’s account. Wüthrich Weinhandel und Keramik reserves the right to demand proof of the defect.

Payment options

Unless otherwise stated, payments must be made in Swiss francs.

Electronic means of payment / Cash on collection

Debit card, TWINT and cash are accepted as means of payment.

Applicable court and place of jurisdiction

Swiss substantive law is applicable to the legal relationship between Wüthrich Weinhandel und Keramik and the clientele. The place of jurisdiction is 8810 Horgen.
